Exceptionalism and 复古主义 II

https://en.wikipedia.org/wiki/American_exceptionalism

Mr Ho added: “The attackers stormed in and started yelling, ordering people to 'Lie down on the ground! Get down on the ground!'
"I knew that if anyone did that, they’d be dead. I had to delay them, stall them any way I could.
“With my hands up, trying to look non-threatening, I stared back at them and said one word: NO.
“Firmly. Calmly. The one in the blue Arsenal away shirt walked toward me, barking “get on the floor!”. Again, I said no.
"I took a step back, keeping the knives at a distance and tried to keep them talking, not attacking anyone. ‘Talking is good. It buys time,’ I said to myself.”

AMENDMENT XXIV

Section 1

Section 2

Southern states enacted poll taxes of one or two dollars per year between 1889 and 1966 as a prerequisite to voting. A citizen paid the tax when registering and then annually thereafter; some laws required payment up to nine months before an election. Furthermore, many states had a cumulative feature that required an individual to pay all previous years' poll taxes before he could vote in the instant year.
Prior to the enactment of poll taxes, property ownership was frequently a prerequisite to voting. States instituted the poll tax early in the nineteenth century as a device to grant voting rights to individuals who did not own real property. Although most states had dispensed with both property qualifications and the poll tax by the time of the Civil War, the tax resurfaced in the South to dilute the effect of race-neutral voting provisions required in Southern states' constitutions as a condition for readmission to the Union following the Civil War.
The most recent amendments were generally two categories:
A)  voting rights and removal of voting barrier for some groups (women-XIX, blacks in Southern states-XXIV, younger adults 18-20 year olds who were conscripted to fight the Vietnam War yet received no voting rights-XVI)
B)  procedural.  (the rest)

Please research them online.  Sometimes Supreme Court hand down extremely influential decisions that seemed to almost bypass the Constitutional Amendment and law making process.

We skip Amendment XIX(Women's suffrage)
We skip Amendment XX (Presidential Term Amendment)
”The Twentieth Amendment appears simply to embody minor structural changes to the Constitution. That the amendment was ratified by the states more quickly than any other constitutional amendment before or since supports this impression of an uncontroversial technical revision. So does the absence of litigation surrounding the meaning of the amendment. But the Twentieth Amendment became part of the Constitution only after decades of congressional debate, and its meaning was debated as recently as the impeachment of President William Jefferson Clinton by the United States House of Representatives in December 1998.“

AMENDMENT XXI

Section 1

Section 2

Section 3

Remember Prohibition Amendment was ratified on a wave of progressive support in 1919 (after WW I).  Now it was essentially repealed in 1933.

Scaling is our friend, Scaling is our enemy.

Quoted from above。
The Eighteenth Amendment, enacted in 1919, was one of four "Progressive" Amendments passed and ratified in quick succession. Although the American involvement with alcohol and with temperance movements had been present from the beginning of the country's history, Prohibition rode to easy victory in an alliance with other elements of the Progressive Movement in the early twentieth century. The Sixteenth Amendment, permitting the income tax, freed the government from dependence on the tax on liquor. The direct election of Senators, through the Seventeenth Amendment, made the Senate more amenable to electoral pressure for temperance. Although the Nineteenth Amendment, guaranteeing women the right to vote, was ratified in 1920, it reflected a general acceptance of woman suffrage (and temperance support) already present in the states, many of which allowed women to vote even before the Nineteenth Amendment came into effect.

Businesses supported the amendment to ensure a more reliable workforce, while prejudice against German-Americans and their breweries during World War I helped make Prohibition a patriotic cause. The amendment passed through both Congress and the states with amazing speed. There were no committee hearings in Congress, and debate took less than six hours, most of it centering on the time limit for ratification. The states ratified the amendment within a month.

...
The only problematic element of the amendment was Section 2, granting Congress and the states concurrent enforcement powers. Under its Section 2 powers, Congress enacted the Volstead Act in 1919 over President Woodrow Wilson's veto. The act defined "intoxicating liquors" as any drink with an alcohol content higher than .05 percent, a strict definition that prohibited even the intake of beer. It permitted exemptions for industrial, medicinal, and sacramental uses, and the act also contained a possession exemption for personal use within one's own private dwelling.
In the 1920 National Prohibition Cases, the Supreme Court ruled that, under the Supremacy Clause, states could not enact legislation that conflicted with congressional enactments regarding Prohibition. Because the states had been the engines of much Progressive legislation, the Progressive Movement assumed that the states would actively enforce the amendment, federal law, and their own state laws. The unexpected and widespread reluctance among the states to enforce Prohibition, along with the concomitant development of organized crime and the loss of tax revenues after the start of the Depression, led to a national scandal that undid Prohibition in little more than a decade. Prohibition was repealed in 1933 by the Twenty-first Amendment.

DDJ 79. Unintended Consequences

这一句话继续阐述unintended consequence of good intentions.

AMENDMENT XVII

Explanation

During the half century after the Reconstruction Amendments(XIII,XIV,XV),  no Amendments made through the difficult Amendment process; during the same period, ~10 new States joined the Union.
http://www.ipl.org/div/stateknow/dates.html

1909 opened flood gate for a flurry of amendments.  Amendment XVI (Income Tax Amendment) took 3+ years to ratify, XVII, XVIII, XVIII were concentrated in 1910-1920, and each took 1 year to ratify.    Legislative bodies like all people tend to have temperaments and recency bias.  It happened during this decade, surrounding WW I, stars were aligned for Amendments, some since proven duds (Liquor Prohibition Amendment XVIII), some proven profoundly society-changing,  Amendment XIX (Women's Suffrage),  some in between, like the Senate Election Rule.   All were experiments with unintended consequences.

https://en.wikipedia.org/wiki/Seventeenth_Amendment_to_the_United_States_Constitution
Original Senate Election Rule:
"Originally, under Article I, § 3, Clauses 1 and 2 of theConstitution, each state legislature elected its state's senators for a six-year term.[2]Each state, regardless of size, is entitled to two senators as part of the Connecticut Compromise between the small and large states.[3] This contrasted with the House of Representatives, a body elected by popular vote, and was described as an uncontroversial decision; at the time, James Wilson was the sole advocate of popularly electing the Senate and his proposal was defeated 10–1.[4] There were many advantages to the original method of electing senators. Prior to the Constitution, a federal body was one where states effectively formed nothing more than permanent treaties, with citizens retaining their loyalty to their original state. However, under the new Constitution, the central government was granted substantially more power than before; the election of senators by the states reassuredAnti-federalists that there would be some protection against the swallowing up of states and their powers by the federal government,[5]providing a check on the power of the federal government.[6]
Additionally, the longer terms and avoidance of popular election turned the Senate into a body that could "temper" the populism of the House. While the Representatives operated in a two-year direct election cycle, making them frequently accountable to their constituents, the senators could afford to "take a more detached view of issues coming before Congress".[7]
So why reform the original Senate election rule?
According to Judge Jay Bybee of the United States Court of Appeals for the Ninth Circuit, those in favor of popular elections for senators believed that two primary problems were caused by the original provisions: legislative corruption and electoral deadlocks.[11] There was a sense that senatorial elections were "bought and sold", changing hands for favors and sums of money rather than because of the competence of the candidate. Between 1857 and 1900, the Senate investigated three elections over corruption. In 1900, for example,William A. Clark had his election voided after the Senate concluded that he had bought votes in the Montana legislature.
... Electoral deadlocks were another issue. Because state legislatures were charged with deciding whom to appoint as senators, the system relied on their ability to agree. Some states could not, and thus delayed sending representatives to Congress; in a few cases, the system broke down to the point where states completely lacked representation in the Senate

"Progressives argued forcefully, persistently, and ultimately successfully that the democratic principle required the Senate to be elected directly by the people rather than indirectly through their state legislatures. By altering the manner of election, however, they also altered the principal mechanism employed by the framers to protect federalism. The framers understood that the mode of electing (and especially reelecting) Senators by state legislatures made it in the self-interest of Senators to preserve the original federal design and to protect the interests of states as states (see Article I, Section 3, Clause 1). This understanding was perfectly encapsulated in a July 1789 letter to John Adams, in which Roger Sherman emphasized that "[t]he senators, being eligible by the legislatures of the several states, and dependent on them for re-election, will be vigilant in supporting their rights against infringement by the legislative or executive of the United States."

In addition to its impact on federalism, the ratification of the Seventeenth Amendment has also had demographic, behavioral, and institutional consequences on the Senate itself. Demographically, popularly elected Senators are more likely to be born in the states they represent, are more likely to have an Ivy League education, and are likely to have had a higher level of prior governmental service. Institutionally, the states are now more likely to have a split Senate delegation, and the Senate now more closely matches the partisan composition of the House."

How the Wilson administration declared War on Germany.  In January 1917, Germany renewed its policy of unrestricted submarine warfare that it had abandoned in 1915 after the sinking of the Lusitania. All ships trading with Britain, including those of neutral countries such as the United States would be targets for their submarines and would be sunk without warning.
In February, the British gave the American ambassador in London a copy of an intercepted German telegram. The telegram came from the German Foreign Secretary, Arthur Zimmermann, to the German ambassador to Mexico. Zimmermann proposed that in the event of war with the US, Germany and Mexico would join in an alliance. Germany would fund Mexico's conflict with the US. With victory achieved, Mexico would regain her lost territories of Arizona, Texas and New Mexico. Release of the telegram ignited a public furor further enflamed by the loss of four US merchant ships and 15 American lives to German torpedo attacks.

DDJ 78.

http://baike.baidu.com/item/%E4%BA%BA%E5%90%9B%E5%8D%97%E9%9D%A2%E6%9C%AF

AMENDMENT XVI

The Sixteenth Amendment, approved by Congress in 1909 and ratified in 1913, made it possible for Congress to enact an income tax without having to worry about whether, under the rules applicable to direct taxes, the tax had to be apportioned among the states on the basis of population.
Congress has the "power to lay and collect taxes," including an income tax, but, under two constitutional provisions (see Article I, Section 2, Clause 3; Article I, Section 9, Clause 4), direct taxes must be apportioned—a difficult requirement to satisfy.

Thus this amendment.  16th Amendment was passed in 1913.  Income tax was passed proposing to target rich mostly and indeed at first apply to rich mostly.  But this changed after 20+ years,  payroll income tax targeting middle class and working class becomes increasingly on hook.

Alaska, Florida, Nevada, South Dakota, Texas, Washington and Wyoming has no State income tax.    These states tend to have more distinct budget and legislature culture.   http://www.cbpp.org/research/state-budget-and-tax/policy-basics-where-do-our-state-tax-dollars-go
